La carta de porte únicamente sirve como comprobante de pago del flete, no tiene valor como contrato.

El porteador es siempre el propietario de las mercancías que se transportan.

El remitente y el destinatario pueden ser la misma persona en un contrato de transporte.

En el transporte aéreo internacional, el documento equivalente a la carta de porte es la guía aérea (air waybill).

Si las mercancías sufren daños por fuerza mayor, el porteador está obligado a indemnizar al remitente.

El destinatario tiene derecho a rechazar la mercancía cuando los gastos de recepción y conservación no estén cubiertos por el remitente.

El contrato de transporte solo es mercantil si se trasladan mercancías, nunca cuando se trasladan personas.

El porteador puede retener las mercancías transportadas si no se le paga el flete estipulado.
