لا يجوز بيع حق مالي كبديل عن سلعة مادية.

يلزم أن تكون السلعة المعقود عليها موجودة وقت التعاقد.

يمكن أن يتضمن عقد البيع شرطاً يتعلق بجودة السلعة أو زمن التسليم.

إذا تعذر وجود السلعة وقت التسليم يجوز الاتفاق على فسخ العقد أو تعديل الشرط.

البيع ينقسم من حيث زمن التسليم إلى بيع حال وبيع آجل.

من حيث موضوع العقد يمكن أن يكون البيع لسلعة محددة قابلة للتعيين.

البيع من حيث الوقت يقتصر على البيع الآجل فقط.

يلتزم البائع بنقل الملكية للمشتري مقابل الثمن المتفق عليه.
