El protesto el acto público cuya función es probar que un título se presentó para su aceptación y no fue de ningún modo aceptado o pagado, ya sea total o parcial.

El protesto se regula del artículo 139 al 149 de la Ley General de Títulos y Operaciones de Crédito.

Si no está presente la persona que se debe levantar el protesto, no hay forma de que se diligencie.

Si la causa del protesto es la falta de aceptación, debe levantarse en los dos días hábiles a su presentación, pero siempre antes del vencimiento.

Si la causa del protesto es la falta del pago, debe levantarse en los quince días hábiles siguientes de su vencimiento.

El protesto debe insertarse en el documento o en la hoja adherida a él.

El protesto por falta de aceptación libera al tenedor de la presentación para el pago y del protesto por falta de pago.

El protesto por falta de pago debe levantarse contra las personas en los lugares y direcciones señalados en la letra, o en su defecto en el domicilio o residencia del girado-aceptante.
