القبض يعتبر جزءاً لا يتجزأ من صحة عقد البيع في كثير من المعاملات.

يجوز القبض بالبيع قبل انعقاد العقد دون رضا الطرفين وفي أي وقت.

من حق المشتري أن يبيع السلعة قبل استلامها حتى لو لم يتم تسليم الثمن.

يشترط عقد البيع وجود المجلس للاتمام والتعاقد بين الطرفين.

التصرف بالبيع يجب أن يتموفقاً للضوابط الشرعية وعدم الغش والتدليس.

يُسمح بتغيير الثمن بين طرفي العقد بعد الإبرام دون موافقة الطرف الآخر.

7

يجوز البيع في جميع الأوقات بشرط وجود الثمن ومحل البيع.

8

يجوز البيع في كل مكان ماعدا المساجد
