La fiscal ocurre cuando el contribuyente : oculta , o simula hechos económicos , para reducir o evitar impuestos legalmente causados , violando la ley tributaria . Es , sancionable y en algunos casos penal .
Características hay ingresos que no se declaran o se disimulan , se presenta : ( Simulación contractual , en cifras , Omisión de información ) , el impuesto sí debía pagarse . Ejemplos : Salarios disfrazados como pagos no salariales ; No declarar ingresos efectivamente recibidos ; Facturas falsas o ; Pagos en efectivo " por debajo de la mesa " .

La consiste en usar figuras legales válidas , para reducir la carga tributaria sin ocultar hechos ni falsear la . Es legal , pero no ilícita por sí misma .
Características de la elusión : no hay simulación , los actos son ( Reales , Transparentes ) , se aprovechan : ( Opciones , Beneficios , Vacíos normativos ) Ejemplos : Planeación tributaria válida ; Estructuración legal de ingresos no salariales válidos ; Elegir figura jurídica menos
