Se usa cuando hay pruebas claras que refutan la afirmación.

No siempre exige pruebas positivas para sostener la conclusión; a veces se apoya solo en la ausencia de evidencia.

También se llama "apelación a la ignorancia" y se usa cuando falta evidencia contraria para apoyar una afirmación.
